INDIVIDUAL GUESTS ON SITE
1. contracting parties
The contract is concluded between the booking customer (hereinafter referred to as the customer) and Sommerrodebahn Betreiber GmbH & Co KG (hereinafter referred to as the company) with whom the service is booked. The booking is made exclusively on the following terms and conditions.
2 Conclusion of contract/ Prices
The prices are the "ticket prices" stated at the ticket offices for the respective service or service category requested.
The client indicates his or her desired visiting time on site. The entrepreneur checks the free capacities accordingly. By paying for the ticket at the cash desk, the customer accepts the conditions and the entrepreneur issues the tickets accordingly. The contract is thus concluded.
3. revocation
In the case of on-site sales, a joint appointment is arranged so that there is no right of withdrawal for the customer.
4. cancellation provisions / cancellation by the customer
Cancellation of the booking is not possible. No refund will be granted if the appointment is not taken up by the client due to delay or is not taken up at all for other reasons and the entrepreneur is not responsible for this.
If the customer does not keep a booked appointment, the ticket loses its validity.
Force majeure (e.g. bad weather) or other events that are not within the entrepreneur's sphere of influence do not justify any claim to cancellation of the booking or reimbursement of services already provided.
5 Cancellation by the entrepreneur
If the entrepreneur has to cancel the booking due to force majeure, this does not constitute a claim for reimbursement of the payment made by the client.
The entitlement to the validity of the ticket lapses directly upon validation, i.e. in the event of short-term closures due to force majeure after validation, there is also no entitlement to replacement or refund.
6 Admission, visit and use of the attractions
The customer must show his ticket at the entrance to the respective attraction, which will be handed over to him at the cash desk.
The use of the attraction(s) takes place at the respective booked time. The customer is responsible for arriving punctually at the booked attraction. In the event of a delay on the part of the customer, admission to use the attraction can no longer be granted. A booked time slot does not guarantee immediate admission at the booked time. In the event of various organisational procedures, such as disruptions in the operating procedures of the attraction, the Company reserves the right to keep the guests waiting on site for a reasonable period of time without this giving rise to any cancellation claims on the part of the customer.
7 Exchange, incorrect booking and discount
If the customer has booked the wrong ticket category (e.g. child instead of adult), the difference to the valid ticket category must be paid at the ticket office before admission. If the customer books a ticket with a higher value than the valid ticket category, the difference will not be refunded.
Possible discounts can only be redeemed on site. Discount entitlements must be presented directly at the time of booking. They can no longer be credited once the tickets have been produced.
There is no right to exchange or rebook tickets. By submitting his offer, the customer confirms the correctness of the booked data and tickets.
8. further agreements
In addition to the T&Cs listed here, the respective terms and conditions of use of the attractions booked apply. The GTC listed here do not regulate the execution of the visit.
Further agreements require the written form. Verbal collateral agreements are not valid.
9 Jurisdiction
For all legal disputes in connection with or in relation to (online) bookings via the website and the online shop of the Entrepreneur or on site, German law shall apply exclusively and national courts in Germany shall have exclusive jurisdiction.
Furthermore, the place of jurisdiction for merchants is Medebach.
Should any provision of these terms and conditions be or become invalid, this shall not affect the validity of the remaining terms and conditions.
By booking, the customer accepts the above conditions.
ONLINE TICKET INDIVIDUAL GUESTS
1. contracting parties
The contract is concluded between the booking customer (hereinafter referred to as the customer) and Sommerrodelbahn Betreiber GmbH & Co. KG (hereinafter referred to as the "Company") with whom the service is booked. The booking is made exclusively under the following conditions.
2 Conclusion of contract/prices
The "ticket prices" shown in the online shop of the Entrepreneur for the respective desired service or service category shall apply as prices.
During the booking process, the customer goes through various steps in which the selected attraction(s), the date of the visit and, if applicable, the time of the visit and the visitor(s) are recorded. The customer must identify himself/herself by providing the data listed in the ordering process. By sending the booking, the customer submits his offer. In doing so, the customer has the choice between the payment methods listed in the booking process. Customer in the booking process and credit card/account holder for payment must match.
By sending the booking confirmation together with the ticket, the Entrepreneur accepts this offer. These are sent immediately after receipt of the order and payment of the ticket price via the payment service provider Adyen. The contract is thereby concluded.
3. disclosure of address
In the event of non-redemption of the credit card payment or in the event of an objection to the credit card payment, the credit institution, indicated by the bank code, shall be instructed by the buyer to disclose the name and address of the customer to the merchant or the payment service provider Adyen so that they can assert their claim against the customer.
4. revocation
Pursuant to § 312g para. 2 no. 9 BGB (German Civil Code), the customer has no right of revocation, as our offers are leisure activities which provide for a specific date/period of performance.
5. cancellation policy / cancellation by the customer.
Cancellation of the booking is not possible. No refund will be granted if the appointment is not taken by the customer due to delay or for other reasons, not taken at all, and the Erlebnisberg Kappe is not responsible for this.
If the customer does not attend a booked appointment, the ticket remains valid for 365 days. It is not possible to re-book a new appointment. However, the ticket can still be redeemed - as long as capacities are free - without prior registration on site.
Force majeure (e.g. bad weather) or other events that are beyond the control of the company do not justify any claim to cancellation of the booking or reimbursement of services already provided.

If payment is cancelled or credit card charges are objected to, or if the Entrepreneur discovers discrepancies in the booking, the Entrepreneur may cancel the tickets and deny access.
If the Company has to cancel the booking due to force majeure, whether at short notice or in advance of the booked date, this does not entitle the customer to a refund of the payment made. Tickets purchased online in advance remain valid for 365 days. It is not possible to re-book a new date. However, the ticket can still be redeemed on site without prior registration - as long as capacities are available.

Discounts (e.g. SauerlandCard) can still be redeemed on site if ticket allotments are still available.

GENERAL TERMS AND CONDITIONS FOR GROUPS
(FROM 15 PERSONS & FOR BOOKINGS VIA THE SALES OFFICE)
1 Conclusion of contract and booking process
1.1 Contracting parties
The contract is concluded between the booking customer (hereinafter referred to as the customer) and Sommerrodelbahn Betreiber GmbH & Co. KG (hereinafter referred to as the "Company") with whom the service is booked. The booking is made exclusively under the following conditions.
1.2 Bookings
The booking of the non-binding offers is made by e-mail regardless of the previous communication medium (telephone, post, fax, ...). After receipt of the booking, you will receive a booking confirmation from the entrepreneur. The contract is only concluded through the booking confirmation.
2. offers
Written offers, unless otherwise stated in the offer itself, shall remain valid for 30 days, but no later than 7 working days before the deadline. The date of the offer is decisive. If the planned date of the visit is within the next 6 working days, written offers shall remain valid for 24 hours. An offer can be accepted up to 24 hours before the appointment at the latest.
3. cancellation on the part of the participant
The following cancellation conditions apply for group programmes:
I. Cancellation is possible free of charge up to a maximum of 7 working days before the appointment.
II. free rebooking is possible up to a maximum of 3 working days before the appointment
a. The replacement date must be within the next 2 months after the originally booked event date. Should the end of the season fall within this period, the date must be made up by then at the latest.
b. For the replacement date, all cancellation rights of the customer shall lapse. The new date cannot be cancelled or rebooked.
c. If the alternative date is not kept, our cancellation fees will automatically apply.
III. cancellations within 2 working days before the appointment or non-appearance of the group will be charged according to the cancellation fees.
Cancellation & rebooking requests must be received by the entrepreneur in writing within the specified period. In the event of a rebooking, the entrepreneur can only offer a new date if there is still sufficient capacity available for this. There is no right to a requested date.
If a rebooked event is not made up within two months, the cancellation fees will also apply here after the deadline has expired.
The cancellation periods apply regardless of the time of booking.
If the group modules archery and guided tours of any kind are part of the program, we charge a flat fee of 15.00 euros per module for a cancellation or a rebooking in addition to other possible cancellation fees.
Any costs incurred by third-party providers - including Panorama Restaurant & Café - must be paid 100% by the customer. The respective general terms and conditions of the external and third-party providers apply.
4. cancellation fees
In the event of a cancellation by the participants under the conditions stated above, the contractor shall charge 90% of the participation fee, provided that there is no statutory right of cancellation and the reserved places have not yet been booked by other guests.
5. terms of payment
Events can be paid either directly on site or by invoice after the event.
Invoices are payable upon receipt within fourteen days without deduction. If the invoice amount is not received within 30 days of the invoice date, the entrepreneur is entitled to charge interest on arrears at the legally prescribed rate.
Invoices are sent by mail.
6. change in the number of persons
Changes to the number of persons must be made in writing within the period specified below.
The number of persons can be changed at any time up to 7 working days before the event. It is not possible to go below 15 pax. In this case, we will invoice the agreed event at a flat rate for 15 people.
The number of persons can also be changed free of charge up to 3 working days before the event:
Up to 39 pax, the number of persons can be reduced by up to 3 pax.
From 40 pax, the number of persons can be reduced by up to 10%.
In the event of reductions at short notice, no-shows or changes that exceed the permitted reductions, 90 % of the agreed price per deviating person will be due, unless the tickets can be sold elsewhere. In the event of a higher number of persons than registered, the additional persons will be charged at the full price.
7. event cancellation, lateness and non-appearance by the client(s)
In case of cancellation or early departure from the event by the participant, no refund will be made. Any additional costs incurred as a result shall be borne by the participant. If agreed dates are not kept, whether due to non-appearance or delays on the part of the client, these will be charged in accordance with the cancellation fees!
8. withdrawal on the part of the entrepreneur
If there are reasons (e.g. force majeure, natural disasters) which make it impossible to hold the event or which pose a risk to the life, health or body of the participant which goes beyond the normal risk of the event, but which were not yet apparent when the contract was concluded, these entitle the company to withdraw from the contract at short notice. The payment made will then be refunded minus the services already claimed. Further claims are excluded insofar as these are not damages within the meaning of No. 8 of these GTC.
Claimed service means all services where tickets have been validated.
9 Liability of the entrepreneur
The Contractor shall only be liable for injuries to life, body or health if these are based on an intentional or negligent breach of duty by the Contractor or its vicarious agents.
Other damages shall only be compensated if they are based on a grossly negligent breach of duty by the Contractor or on an intentional or grossly negligent breach of duty by its legal representative or vicarious agent.
10 Insurance
The participant is not insured by the company. The participant is obliged to provide sufficient and valid insurance cover (accident and health insurance). These insurances must be taken out by the participant himself/herself. All participants should be able to cope with the demands of the activity. They are responsible for their own actions and their physical and mental health.
11 Complaints/Deficiency Notification
Any defect must be reported and explained by the Client to an employee of the Contractor. Otherwise, a (partial) refund of the remuneration is not possible.
12. copyrights
The Contractor's documents and electronic media are subject to copyright and may not be reproduced photomechanically or electronically at any time or under any circumstances. They are only intended for the personal use of the course participants. This does not apply to private copies of documents or electronic media that have previously become the property of the clients, but whose authorship still lies with the entrepreneur.
13.special agreements
Special agreements shall be made in text form. If offers contain further agreements, these shall apply preferentially to the GTC set out here.
Should any provision of these terms and conditions be or become invalid, this shall not affect the validity of the remaining terms and conditions.
14 Applicable law and place of jurisdiction
German law shall apply exclusively to all legal disputes in connection with or relating to online bookings made via the Lessor's website.
Furthermore, the place of jurisdiction for merchants is Medebach (Germany).
